You read it here second (Groklaw was first): SCO loses.

Actually, SCO lost big time. The court ruled that Novell owns the source code and copyrights to Unix SVRX and that SCO was negligent in not turning over the funds it accepted from Sun and Microsoft for SRVX licenses. Because Novell owns the keys to Unix, the SCO suit against IBM has been dismissed (it was waived by Novell in June 2003). Not only does SCO now owe Novell a huge truckload of cash that exceeds their current valuation, but now IBM is likely to prevail in their counter suit. The only question is, who gets the chairs?

I’ve been watching this case, in utter disbelief, since it started in 2003. I even went as far as blasting SCO products off of every server in my research and development lab. I strongly believed that Novell owned the copyrights and that SCO had no basis for killing IBM’s license. Anyone who has any understanding of the history of Unix/BSD and Linux knew this was the case. SCO hired David Boies to twist history and the English language in filing after filing in an effort to prove their unprovable cases.I hope you’re happy Darl (McBride). You got what you deserved.
